The town and ICP entered a settlement in 2005, after a U.S. District Court ruled that the town had used discriminatory planning and zoning practices centered on the exclusion of apartments and smaller single-family lots. The town was given three years to identify 70 units favorable for low-income rental or purchase. But the town has not identified a single site, the suit claims.
